1. Acceptance of Terms
These Terms constitute a legally binding agreement between you ("you" or "User") and BrainBattle ("we," "us," or "our"), governing your access to and use of the website at dailybrainbattle.com, our mobile application, and all related services (collectively, the "Service"). We reserve the right to modify these Terms at any time. Material changes will be communicated by posting the revised Terms on the Service with a new effective date.
2. Eligibility
You must be at least 13 years of age to use the Service. If you are between 13 and 17 years of age, you may only use the Service with the consent and supervision of a parent or legal guardian who agrees to be bound by these Terms.
3. Account Registration
To access certain features of the Service, you must create an account. When creating an account, you agree to:
- Provide accurate, current, and complete information.
- Maintain and promptly update your account information.
- Maintain the security and confidentiality of your login credentials.
- Accept responsibility for all activities that occur under your account.
- Notify us immediately of any unauthorized use of your account.
We reserve the right to suspend or terminate your account at our sole discretion if we suspect any breach of these Terms or any fraudulent, abusive, or illegal activity.
4. Description of the Service
BrainBattle is a competitive intelligence platform that provides daily AI-generated brain challenges, including questions across categories such as logic, science, and culture. The Service includes features such as global leaderboards, streak tracking, shareable result cards, and private leagues. The Service is provided on a freemium basis, with a free tier and a paid subscription tier ("Pro").
5. Subscription and Payment
5.1 Free Tier
The free tier provides limited access to the Service, including one daily challenge, access to the global leaderboard, a shareable result card, and streak tracking.
5.2 Pro Subscription
The Pro subscription provides enhanced features, including additional daily challenges, private leagues, extended performance history, and streak protection. The current subscription price is $4.99 per month, subject to change with reasonable notice.
5.3 Payment Processing
All payments are processed by our Merchant of Record, currently Lemon Squeezy, Inc. By subscribing to Pro, you authorize Lemon Squeezy to charge your selected payment method on a recurring basis. Lemon Squeezy handles all payment processing, sales tax collection, and compliance as the Merchant of Record.
5.4 Cancellation and Refunds
You may cancel your Pro subscription at any time through your account settings or by contacting us at brainbattle@dailybrainbattle.com. Upon cancellation, you will retain access to Pro features until the end of your current billing period. No refunds will be issued for partial billing periods. If you believe you have been charged in error, please contact us within 14 days of the charge at brainbattle@dailybrainbattle.com.
5.5 Price Changes
We reserve the right to change subscription prices. We will provide at least 30 days' notice before any price increase takes effect.
6. Intellectual Property
6.1 Our Intellectual Property
All content, features, and functionality of the Service are the exclusive property of BrainBattle or its licensors and are protected by applicable intellectual property laws. The BrainBattle name, logo, and all related names, logos, product and service names, designs, and slogans are trademarks of BrainBattle.
6.2 AI-Generated Content
Questions and challenges are generated using artificial intelligence (Anthropic's Claude API). While we review and curate AI-generated content, we do not guarantee the accuracy, completeness, or appropriateness of every question. AI-generated questions and related content are the property of BrainBattle.
6.3 User-Generated Content
If you submit content to the Service (such as league names or display names), you grant us a non-exclusive, worldwide, royalty-free, perpetual, irrevocable license to use, reproduce, modify, display, and distribute such content in connection with the Service.
7. Acceptable Use
You agree not to use the Service to:
- Violate any applicable law or regulation.
- Use automated means (bots, scrapers, scripts) to access the Service or manipulate leaderboards.
- Attempt to gain unauthorized access to any portion of the Service or other users' accounts.
- Interfere with or disrupt the Service or servers connected to the Service.
- Cheat, manipulate scores, or undermine the integrity of the competitive experience.
- Impersonate any person or entity.
- Transmit any viruses, malware, or other harmful code.
- Harass, bully, threaten, or intimidate other users.
- Use the Service for any unauthorized commercial purpose.
8. Leaderboards and Rankings
The Service includes global and private leaderboards that rank users based on performance. We reserve the right to remove users from leaderboards or reset scores if we determine, in our sole discretion, that a user has engaged in cheating, manipulation, or any violation of these Terms.
9. Certified Intelligence Score™ (Future Feature)
We may in the future offer a Certified Intelligence Score™ ("CIS") based on sustained gameplay performance. Use of CIS will require your explicit consent. CIS is a proprietary metric of BrainBattle and is not a clinical or scientific assessment of intelligence.
10. Disclaimer of Warranties
The Service is provided on an "as is" and "as available" basis, without warranties of any kind. We do not warrant that the Service will be uninterrupted, error-free, or secure. We do not warrant the accuracy or completeness of any AI-generated content.
11. Limitation of Liability
To the maximum extent permitted by applicable law, BrainBattle shall not be liable for any indirect, incidental, special, consequential, or punitive damages. Our total aggregate liability shall not exceed the greater of $50.00 or amounts paid by you in the twelve months preceding the claim.
12. Indemnification
You agree to indemnify, defend, and hold harmless BrainBattle and its officers, directors, employees, agents, and affiliates from and against any claims, damages, losses, liabilities, costs, and expenses arising out of or relating to your use of the Service or violation of these Terms.
13. Dispute Resolution and Arbitration
13.1 Informal Resolution
Before filing any formal dispute, you agree to first contact us at brainbattle@dailybrainbattle.com and attempt to resolve the dispute informally for at least 30 days.
13.2 Binding Arbitration
If we cannot resolve a dispute informally, you and BrainBattle agree that any dispute arising out of or relating to these Terms or the Service shall be resolved by binding arbitration administered by the American Arbitration Association (AAA) in the State of Delaware.
13.3 Class Action Waiver
You and BrainBattle agree that each may bring claims against the other only in an individual capacity and not as a plaintiff or class member in any class proceeding.
14. Governing Law
These Terms shall be governed by the laws of the State of Delaware, United States of America, without regard to its conflict of law provisions.
15. Termination
We may terminate or suspend your account and access to the Service immediately, without prior notice or liability, for any reason, including if you breach these Terms. Upon termination, your right to use the Service will immediately cease.
16. Severability
If any provision of these Terms is held to be invalid or unenforceable, such provision shall be modified to the minimum extent necessary or severed. The invalidity of any provision shall not affect the remaining provisions.
17. Entire Agreement
These Terms, together with the Privacy Policy, constitute the entire agreement between you and BrainBattle regarding the Service.
